Trackdays, road bikes and insurance

I was reading an article last night by Andrew Dalton, the biking solicitor.

He was saying that if you own a road bike, tell your insurance company it is NOT used off road, take it on a trackday, have an accident and hurt someone else, then your insurance company is liable for a third party claim and they might want to claim that back off you personally for not declaring you use it for trackdays.

Is that correct?

If you're asked you could just lie to the person and say you aren't insured.

I don't think I've ever been asked if I use my bike off road.

Seems a bit weird to mention it now. People have been using their road bikes on the track for years.

I'll check tomorrow to see if there's been any changes in case law. Up to now insurance companies haven't been involved. I wonder if a claimant has gone after an insurer to guarantee payment?

This was the case Dalton quoted but he reckoned it was already part of British law anyway.

Like I say, I'll check but I'm not aware of any recent changes to the case law.

Paced events are different to track days that’s why tuning isn’t allowed
