Buying online - basic contract law

Not sure really apart from the price. I just had a look on amazon and couldn't find a 10 below 250 in your size, then I came across this one in my size. Obviously a mistake, but I've paid up lets see if they send it.

If they don't surely that's false advertising and therefore they have to honor it anyway. Unless they say they haven't got any more in stock haha

Yes I think legally they have to honour the sale, but would be very easy to come up with an excuse. No stock etc

Nope....they don't have to sell you anything at any price....it belongs to them, simple as that.

Afaik you would be right that they do not have to honour an invite to buy, (wait) however once they have accepted the offer (Monty has now paid the offered price ) then they have entered into the contract of sale. (nod)

I think I'm going to invent an internet payment site. I'm going to call it PayPal, 'cos I'm a friendly guy.

Then I'm going to make any sort of dispute drag on for ages until people give up and buy something else instead.

Acceptance of payment isn't necessarily an agreement of a contract. Most websites will usually state this somewhere in their Ts & Cs.

From a UK Consumer Rights website

"The legally binding contract is complete when a retailer accepts an order. However, acceptance does not necessarily happen at the point of order. Even the confirmation email may not be an acceptance. Some retailers reserve the right to cancel an order up to the point of delivery. It is therefore important to carefully check the retailer’s terms and conditions (which must be available on their website) and emails – if a retailer simply acknowledges an order, there may be no contract at that point."

I dont think you would have a case if they refused to sell at that price because as Monty stated in the original post its obviously a mistake .

Think it will actually come down to the contract Amazon has with the seller. Amazon has accepted the sale on the sellers behalf under their "A-to-z Safe Buying Guarantee" whatever the chuff that is!

Either way will be interesting to see what happens. I bought it on an American Express credit card so I will get "their" money back if it doesn't happen.

Sometimes you have a win. I had to take my dog to a vet after hours for emergency surgery many years ago. He had to do a manual visa transaction because he had no office lady there. I watched him write in $3.50 instead of $350.00 but I said nothing because he had been a complete prick through the whole ordeal. I waited months for a further invoice (that I would have paid) but got nothing (rock)
