Oscar Pistorius

Post by Kwacky »

The Judge is giving her verdict today. I can't see him getting off with it.

http://www.bbc.co.uk/news/world-africa-29143544" onclick="window.open(this.href);return false;

The Judge has a number of options.

Premeditated murder Intended and planned to unlawfully kill Reeva Steenkamp, or an intruder
Mandatory life term - 25 years before parole

Common-law murder Unlawfully intended to kill in the heat of the moment but without "malice aforethought". Either: Shot door intending to kill, or knew someone might be killed and still fired gun
Minimum of 15 years up to 20 years, at judge's discretion

Culpable homicide (manslaughter)
No intention to kill. Takes into account disability, but actions negligent and not in keeping with a reasonable person
Maximum of 15 years, possibly between seven and 10 years

Discharging a firearm in public
Two counts for allegedly firing a gun through a car sunroof and discharging a gun at a restaurant
A fine or up to five years - for each charge

Illegal possession of ammunition
In possession of .38 bullets for which he has no licence
A fine or up to 15 years

She won't find him guilty of murder. I reckon she'll throw a few of those at him and give him 15 years.

Been following it on and off this morning, the Judge has disregarded a chunk of the Prosecutions evidence, my guess is it'll go to Culpable Homicide with the other offences to run concurrently.

Be interesting to get Casper's take on this.

I sit with a couple fo Saffa's at work. They said it is pretty much unheard of for a white person with money to spend anytime in prison. I was reading that the mansluaghter charge can be maximum 15 years, minmum of a fine.....we will see tomorrow

6 years for murder.

What a farce.

In an hour-long session, Judge Thokozile Masipa said mitigating circumstances, such as rehabilitation and remorse, outweighed aggravating factors for deviating from the prescribed 15-year sentence for murder.

Doesn't bring his girlfriend back though, does it?

Seems like a reasonable and well-considered judgement to me.

Of course you would, you come from somewhere that has owning guns and blowing away anything that moves in its 'god damn' constitution.

That guy was a gun nut and trigger happy and was just itching for an excuse to use it in anger. He didn't correctly identify his target, he just blew holes through a door at a 'suspected' intruder.

His actions don't even comply with the laws of armed conflict while at war, let alone a residential house. And before you jump on your gun toting wild horse again, yes I do know a bit about it, my Sqn was on standby in 2000/2001 and we all got put through level 1 & 2 LOAC training.

Deserves more than 6 years.
